(“STICKMAN”) knows that you care about how your personal information is used and shared, and we take your privacy seriously.  Please read the following to learn more about our privacy policy. By visiting WWW.STICKMAN.TV OR WWW.TRACTIONRADIO.COM (TOGETHER, the “STICKMAN websites”), or downloading or using any software we offer on the stickman websiteS (INCLUDING THE TRACTION RADIO PLAYER), you acknowledge that you accept the practices and policies outlined in this Privacy Policy.  IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE STICKMAN WEBSITES OR OUR SOFTWARE (INCLUDING THE TRACTION RADIO PLAYER).

What Does This Privacy Policy Cover?

Personal Information means any information that may be used to identify an individual, including, but not limited to, a first and last name, a home or other physical address, and an email address or other contact information, whether at work or at home.   This Privacy Policy covers Personal Information that STICKMAN gathers when you are accessing the STICKMAN Websites and when you are downloading the software we provide or otherwise using our services (including the TRACTION RADIO Player).  Also, this Privacy Policy covers STICKMAN’s treatment of any Personal Information that our business partners share with us.  This Privacy Policy does not apply to the practices of companies that STICKMAN does not own or control, or to individuals that STICKMAN does not employ or manage.

What Personal Information Does STICKMAN Collect?

The information we gather from our users enables us to personalize and improve our services.  We collect the following types of information from our users:

Personal Information You Provide to Us:

We receive and store any information you enter on the STICKMAN Websites or provide to us in any other way.  The types of Personal Information collected include your name, age, gender, email address, demographic information, and ratings/comments.  You can choose not to provide us with certain information, but then you may not be able to take advantage of many of our special features.  The Personal Information you provide is used for purposes such as responding to your requests for certain products and services, customizing the advertising and content you see, and communicating with you about specials and new products.

Personal Information Collected Automatically:

• We receive and store certain types of information whenever you interact with the STICKMAN Websites or use our services (such as the TRACTION RADIO Player).  STICKMAN automatically receives and records information on our server logs from your browser, including your IP address, STICKMAN cookie information, and the page you requested.

• Generally, our service automatically collects usage information, such as the number and frequency of visitors to the STICKMAN Websites and their components, songs listened to, etc. using a unique identification number embedded in the TRACTION RADIO Player.  STICKMAN only uses this data in aggregate form (that is, as a statistical measure), and not in a manner that would identify you personally.  This type of aggregate data enables us to figure out how often users use parts of the STICKMAN Websites or our services (including the TRACTION RADIO Player) so that we can make the STICKMAN Websites appealing to as many users as possible, and improve those services.  As part of this use of information, we may provide aggregate information to our partners about how our users, collectively, use the STICKMAN Websites and our software.  We share this type of statistical data so that our partners also understand how often people use their services and the STICKMAN Websites, so that they, too, may provide you with an optimal online experience.  Again, STICKMAN never discloses aggregate information to a partner in a manner that would identify you personally.

• Many companies offer programs that help you to visit websites anonymously.  While STICKMAN will not be able to provide you with a personalized experience if we cannot recognize you, we want you to be aware that these programs are available.

What About Cookies?

• Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your browser to enable our systems to recognize your browser and tell us how and when pages in the STICKMAN Websites are visited and by how many people.  STICKMAN cookies do not collect Personal Information, and we do not combine the general information collected through cookies with other Personal Information to tell us who you are or what your screen name or email address is.

• Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways.  We strongly recommend that you leave the cookies activated, however, because cookies enable you to take advantage of some of the STICKMAN Websites’ most attractive features.

How Else Does STICKMAN Use Any of the Personal Information It Receives?

Other than as set forth in this Privacy Policy, we may use the Personal Information you provide about yourself to fulfill your requests for our products, programs, and services, to respond to your inquiries about our offerings, and to offer you other products, programs or services that we believe may be of interest to you.

We sometimes use this information to communicate with you, such as to notify you when you have won one of our contests, if we have one, or when we make changes to our user agreements, to fulfill a request by you for an online newsletter, or to contact you about your account with us.

Although we take appropriate measures to safeguard against unauthorized disclosures of Personal Information, we cannot assure you that the information we collect will never be disclosed in a manner that is inconsistent with this Privacy Policy.

STICKMAN will not use or transfer Personal Information provided to us in ways unrelated to the ones described in this Privacy Policy without also providing you with an opportunity to opt out of these unrelated uses.

Will STICKMAN Share Any of the Personal Information It Receives?

Personal Information about our users is an integral part of our business.  We neither rent nor sell your Personal Information to anyone.  We share your Personal Information as described below:

Affiliated Business We Do Not Control:  We are affiliated with a variety of businesses and work closely with them.  In certain situations, these businesses may operate stores at the STICKMAN Websites or sell items to you through the STICKMAN Websites.  In other situations, STICKMAN provides services, or sells products, jointly with affiliated businesses.  You can easily recognize when an affiliated business is associated with your transaction, and we will share user information that is related to those transactions with that affiliated business.

Agents:  We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you.  Examples include fulfilling orders, sending postal mail or email, removing repetitive information from user lists, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service.  Unless we tell you differently, STICKMAN’s agents do not have any right to use Personal Information we share with them beyond what is necessary to assist us.  You hereby consent to our sharing of Personal Information for the above purposes.

Business Transfers:  In some cases, we may choose to buy or sell assets.  In these types of transactions, user information is typically one of the business assets that is transferred.  Moreover, if STICKMAN, or substantially all of its assets were acquired, or in the unlikely event that STICKMAN goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party.  You acknowledge that these transfers may occur, and that any acquirer of STICKMAN may continue to use your Personal Information as set forth in this Privacy Policy.

Protection of STICKMAN and Others:  We may release Personal Information when we believe in good faith that release is necessary to comply with law or court order; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of STICKMAN, our employees, our users, or others.  This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. 

With Your Consent:  Except as set forth above, you will be notified when your Personal Information may be shared with third parties, and will be able to prevent the sharing of this information.

What Personal Information Can I Access?

All of the Personal Information you provide to us during the registration process, with the exception of your email address, is permanently stored in the TRACTION RADIO Player application and is assigned to your unique player identification number. You can change your email address at any time using the preferences menu in the TRACTION Radio Player application, and this information will be automatically updated in your unique player identification. However, to change any other Personal Information, you must uninstall the TRACTION RADIO Player software and re-install it using new registration information.

What Choices Do I Have?

• As stated previously, you can always opt not to disclose information to us, even though it may be needed to take advantage of certain features of the STICKMAN Websites or to otherwise use the STICKMAN Websites or our software.

• You are able to add or update only your email address; you must uninstall and re-install the TRACTION RADIO Player software to change other information. 

• You may uninstall our software to remove your ability to listen to TRACTION RADIO Player broadcasts.  However, please note that some information regarding your past listening behavior may remain in our records even after you uninstall the software.

• If you do not wish to receive email or other mail from us, please send an e-mail to: support [at] tractionradio.com which indicates your request.  Please note that if you do not want to receive legal notices from us such as this Privacy Policy, those legal notices will still govern your use of the STICKMAN Websites and any software you download from the STICKMAN Websites (including the TRACTION RADIO Player), and you are responsible for reviewing these legal notices for changes.

• As explained earlier, the majority of browsers allow you to monitor and restrict our use of cookies.  Please note, however, that if you do not allow placement of cookies, you will not be able to take advantage of some of our attractive features.

A Special Note About Children

The STICKMAN Websites and software (including the TRACTION RADIO Player) are not designed or intended for use by children under 13.  Children under 13 may not submit any Personal Information to us, and if we discover that we have inadvertently gathered any such information from a child under 13, we will take appropriate steps to delete it. STICKMAN complies with the Children’s Online Privacy Protection Act of 1998 (which is available at http://www.ftc.gov/ogc/coppa1.htm) and does not permit registration by, and will not knowingly collect personally identifiable information from, anyone under 13.

Changes to This Privacy Policy

You agree that STICKMAN may amend, modify, alter or otherwise update this Privacy Policy from time to time in its sole discretion.  Use of information we collect now is subject to this Privacy Policy in effect at the time that information is collected.  If we make changes in the way we use Personal Information, we will notify you by posting an announcement on one or both of the STICKMAN Websites.
